Ombudsman Denies Responsibility for Investigating St Martins Abuse - Again

Again, slight change of plan. Still waiting for response from Google and Bill DeGaris re pulled posts and threatening letter, etc, so I'll just stick to actual documents for this post.

This first attached letter was in response to inquiries made by BraveHearts, and is why I remain genuinely grateful to Hetty Johnson, Carol Ronken, etc, for their efforts, even if I am critical of their ultimate failure to follow through after these first letters.

The then Ombudsman Mr Eugene Biganovsky spends two pages carefully explaining why he is not going to do anything, and repeatedly misrepresents the truth about his possible role and responsibilites

When he directs BraveHearts to the Police Complaints Authority he neglects to mention that the PCA is a Statutory Authority, as is the Teachers Registration Board, and they are therefore within his jurisdiction as he identifies himself on page 2 when discussing the Independent Schools Board;
          "...this is not a statutory body and is therefore not within the jurisdiction of the Ombudsman."

Therefore Statutory Authorities are within his jurisdiction. We parents had lodged official complaints about the corrupted processes of police investigating police, with specific examples of our problems with both SAPol and the PCA, and the PCA is a Statutory Authority.

Parents had already provided the Ombudsman all the information he claims to not have at his disposal.

Either he is not aware or he is lying when he says "...there is an appeal to the Court..." in the TRB. Only the teacher can appeal a TRB decision, complainants like us parents get no appeal, therefore the TRB decisions are not "...of a judicial nature...".

I think Mr Biganovsky sums it up perfectly himself in trying to deny the obvious;
          "I regret that this letter may seem like an excuse why I will not commence an investigation."

Just today 09/04/2013 I received MLC Michelle Lensink's response to my request that she approach the new Ombudsman Richard Bingham re the St Martins Child Abuse Issue, and I have included it as further confirmation that Eugene Biganovsky should have addressed the issues of the "Statutory Authorities", the TRB and PCA, which are quite clearly "in error."

I also note that Mr Bingham states that he "cannot investigate" but it is clearly a continuing case of "won't investigate".
